Services Policy

Introduction

The primary objective of our service policy is to establish the terms and conditions governing the provision of all our services. By contracting any of our services, the client accepts and agrees to these policies.

General Terms of Service

  • Acceptance of Terms: The terms and conditions are considered accepted when the client accepts the quote and signs a service agreement or contract. This agreement formalizes the contractual relationship and establishes the expectations and obligations of both parties.
  • Policy Modifications: These service policies are subject to annual review. Any changes or updates will be communicated to customers through our website (selfish.com.mx) and via email. Customers are responsible for periodically reviewing these policies to stay informed of any modifications.
  • Communication: Our primary means of communication with our clients is through our website, selfish.com.mx, and via email at support@selfish.com.mx. We will use these channels for all important notifications, project updates, and any other relevant communications. Clients are expected to regularly check these channels to stay informed about the progress and updates of their projects.
  • Definition of Delivery: “Project delivery” refers to the moment when the digital product is made available to the client for final review, publication or use, regardless of whether the client publishes it immediately or not.

Customer Responsibilities

  1. Provision of Information: To initiate a project, the client must provide the following: 
    1. Agreed advance 
    2. Signature in service provision agreement or in contract entered into 
    3. All the information required for the project.
      1. Text revision and correction: The client is responsible for reviewing, correcting, and approving the spelling, grammar, style, names, data, and any other textual content provided to Selfish (including texts sent via WhatsApp, email, documents or any other means) before publication. Selfish We are not responsible for spelling mistakes or content errors present in the texts received from the client. Should style/spelling corrections be required by us, SelfishIt must be explicitly requested and may be quoted as an additional service.
  2. Cooperation During the Project: Continuous client feedback is expected during the adjustment rounds, as well as the submission and updating of required information. Active client cooperation is essential for the progress and successful completion of the project.
    1. If the customer does not send feedback within 10 business days after each partial delivery, that stage will be considered approved. 
    2. Abandoned Projects: If no information or data is received from the client in more than 90 calendar days (3 months), the project will be considered "abandoned" and reactivation will cost 4,500 MXN (four thousand five hundred Mexican pesos).
  3. Modifications Not Considered: Any adjustments, changes, or modifications not expressly mentioned in the service agreement or contract are not included in the project price or quote. Any additional work requested by the client will be quoted and invoiced separately.
  4. Information Backup. The client is responsible for maintaining up-to-date backups of their information, content, and data, even when using hosting, maintenance, or backup services provided by Selfish.

  5. Access and Credentials: The client is responsible for securely safeguarding access credentials (users, passwords, keys, tokens and access to providers). Selfish will not be responsible for incidents resulting from unsafe handling, leakage or loss of access by the client or third parties.
  6. Misuse. The client acknowledges that they are solely responsible for their use of the products and services developed by Selfish. Selfish will not be responsible for the improper, fraudulent or illegal use that the client or third parties make of said products or services.

Responsibilities of Selfish

  • Meeting Deadlines and Budgets: Deadlines and budgets are established specifically for each client in the service agreement. We commit to meeting the agreed deadlines and working within the established budget, unless modifications arise that are agreed upon by both parties.
  • Quality and Service Delivery: We are committed to delivering high-quality services and offer a warranty period depending on the type of service contracted. During the warranty period, we provide support for error correction and minor adjustments that do not significantly alter the scope of the original project.
  • Confidentiality and Data Protection: We handle and protect our customers' confidential information with the utmost care, in accordance with our privacy notice available at https://selfish.com.mx/aviso-de-privacidad/We undertake not to disclose any confidential information without the prior consent of the client, unless required by law.

Payment and Billing

  1. Payment methods: We accept the following payment methods:
    1. Electronic transfer.
    2. Cash.
    3. Payment by debit and credit card.
    4. Paid Market.
    5. stripes
    6. PayPal.
    7. Wise.
  2. Payment Terms and Conditions: We typically require a 50% advance payment of the total project cost at the start of the project, with the remaining 50% due upon delivery of the final project. Specific terms may vary depending on the type of service and will be detailed in the service agreement. Please review the relevant section of this service policy for specific details regarding each type of service.
  3. Need an invoice?: Invoices will be issued in accordance with the terms set out in the service agreement. It is the client's responsibility to review and pay invoices within the agreed timeframe. Any billing-related disputes should be reported to Selfish within 7 days of receiving the invoice.
  4. Penalties for Late Payment: In case of late payment, a penalty of 1.5% of the total outstanding amount will be applied for each month of delay. Selfish reserves the right to suspend services in case of non-payment until the situation is rectified.

Refunds

En SelfishWe strive to ensure customer satisfaction with the services we provide. However, we understand that refunds may sometimes be necessary. Our refund policy is as follows:

  1. Conditions for Refunds: Refunds will only be considered if the client is dissatisfied with the service and has communicated their dissatisfaction within the project development time or within 30 days of final project delivery. The client must provide a detailed explanation of the reason for their dissatisfaction and allow [the relevant authority/compliance department] to [the relevant department/compliance department].   2. Refund Amount: If, after attempting to resolve the issues, the customer remains dissatisfied, Selfish We may offer a partial credit of the amount paid to be used for other company services.   3. Exclusions: No refunds will be issued for changes of mind by the client or for project cancellation by the client. Advance payments will not be refunded once work has begun, except in cases where Selfish determine that it is justified due to breaches on our part.
  4. Refund Request Process: Refund requests must be sent in writing to support@selfish.com.mx, including all relevant information and detailed justification. Selfish will review the request and provide a response within 15 business days of receiving the request.
  5. Adjustments and Credits: Instead of a refund, Selfish We can offer to make additional adjustments to the project to meet the client's expectations at no extra cost, provided that such adjustments are within the original scope of the project.

This refund policy is designed to be fair to both our customers and our company, ensuring that the needs and expectations of both parties are taken into account.

Intellectual Property

  1. Rights over the Work Performed: Commercial rights to use the final product are transferred to the customer upon full payment. The customer will be provided with a copy of the final product for commercial use. However, Selfish The client retains intellectual property rights to the design and underlying code used in the project's development. This means that, although the client has the right to use the final product for their commercial purposes, Selfish We retain the rights to the design and code, allowing us to reuse them in other projects, unless otherwise expressly agreed in writing in the quote or service agreement.
  2. Use of Protected Materials: The client is responsible for ensuring that all content provided to SelfishThis includes, but is not limited to, text, images, videos, PDFs, and audio, and must not infringe on the intellectual property rights of third parties. The client must have the necessary rights to use such content in the project. Selfish is not responsible for any claims related to copyright infringement or other intellectual property rights arising from the use of content provided by the client. Furthermore, the client agrees that Selfish Use materials from royalty-free resource banks or with the appropriate licenses for use in the project. Any specific content requests requiring the purchase of additional licenses must be communicated by the client, and the associated costs will be borne by the client.

Warranties and Limitations

  1. Guarantees Offered: Selfish It offers a warranty period depending on the type of service contracted. Please review the corresponding section in this same service policy for specific details on each type of service.
    During this warranty period, support will be provided for bug fixes and minor adjustments that do not significantly alter the scope of the original project. Additionally, upon delivery of the final product, a user manual is provided, and a delivery call and support for using the digital product are included. The warranty does not cover errors or problems resulting from modifications made by third parties or by the client without supervision. SelfishFor services that include maintenance, the scope and duration of such maintenance will be specified in the service agreement. Any request for support or adjustments outside the warranty period will be quoted and invoiced separately.
  2. Limitations of Liability: Selfish is not responsible for any direct, indirect, incidental, special or consequential damages resulting from the use of or inability to use the services provided.
    This includes, but is not limited to, loss of profits, business interruption, loss of data, or other intangible losses, even if Selfish You have been informed of the possibility of such damages. Our total liability for any claim related to the services provided will be limited to the amount paid by the customer for those services.
    Selfish We are not responsible for problems arising from factors beyond our control, such as hosting failures, internet service interruptions, virus attacks, code injection, DDoS attacks, malware, exploits, fraud or misuse by the client's internal staff, or technical problems not attributable to the quality of our work.
    Selfish will not be responsible for spelling, grammar, or information errors when they result from content provided or approved by the client.
    Under no circumstances, Selfish will be responsible for any content provided by the client that infringes the intellectual property rights of third parties. The client agrees to indemnify and hold harmless Selfish from any claim, damage, loss, or expense (including legal fees) arising from any infringement of intellectual property rights related to the content provided by the client. These limitations of liability apply to the maximum extent permitted by applicable law and will remain in effect even after the termination of the service agreement or contract.
  3. Backups, Service Availability and Force Majeure. Upon delivery of any website or application developed by SelfishThe client will be provided with a backup of the project in its final delivered state. This backup is a copy of the final delivered state and does not imply the contracting of a periodic backup service.
    From that moment on, the custody and safekeeping of said information will be the responsibility of the client, unless a hosting or maintenance service is contracted with Selfish.
    When the client has a managed hosting service SelfishAutomatic backups can be performed periodically, according to the contracted plan. These backups will only be delivered when expressly requested by the client. Selfish There is no obligation to provide automatic or recurring backups beyond what is stipulated in the contracted service. If the client does not have a hosting service with SelfishThe generation, recovery or delivery of backups will have an additional cost, which will depend on the complexity and characteristics of the project and will be quoted separately.
    The client acknowledges and accepts that Selfish It relies on external providers for services such as hosting, servers, domains, payment gateways, third-party platforms, and internet services. Consequently, Selfish is not responsible for service outages, loss of information, interruptions, technical failures or unavailability resulting from said providers.
    Likewise, Selfish We will not be liable for damages, losses, or interruptions caused by force majeure events, including, but not limited to, natural disasters, fires, floods, earthquakes, widespread power outages, armed conflicts, acts of government, pandemics, large-scale cyberattacks, or other events beyond our reasonable control.

Conflict resolution

En SelfishWe prioritize mediation as the first resort for resolving any disputes that may arise between the company and our clients. We believe that mediation allows for a faster, more efficient, and more amicable resolution of conflicts, preserving business relationships.

  1. Mediation: In the event of any dispute or disagreement related to our services, both parties agree to attempt to resolve the conflict through mediation. The mediation will be facilitated by a neutral mediator agreed upon by both parties. The costs of the mediation will be shared equally by both parties.
  2. Arbitration: If mediation does not result in a mutually satisfactory resolution, the matter will be submitted to binding arbitration. The arbitration will be conducted in accordance with the commercial arbitration rules of a recognized arbitration body, as agreed upon by both parties. The arbitrator's award will be final and binding and may be entered in any court of competent jurisdiction.
  3. Legal Actions: Only if mediation and arbitration fail to resolve the dispute may the parties resort to legal action. Any legal action must be filed in the competent courts of Guadalajara, Jalisco, and will be subject to the applicable law of that jurisdiction.
  4. Confidentiality: The entire mediation and arbitration process will be confidential. Neither party may disclose information about the dispute, the discussions held, or any agreement reached during the mediation or arbitration, except as necessary for the enforcement of such agreement or as required by law.

These procedures aim to ensure that any conflict is handled fairly, efficiently, and with the least possible impact on the business relationship and operations of both parties.

Payment Terms and Conditions

    1. For websites focused on physical presence, corporate websites, and landing pages:
        1. An initial payment of 50% of the total project cost is required at the start of the project.
        2. The remaining 50% will be paid upon delivery of the final project.
    2. For web applications:
        1. Payment can be structured as follows if mutually agreed:
          1. 40% of the total project cost at the start of the project.
          2. 30% halfway through development.
          3. 30% upon delivery of the final project.

Approval by Lack of Feedback: If the customer does not send feedback within 10 (ten) business days after the partial delivery or review request, that stage will be considered approved.

Content Responsibility: The content of the website is the responsibility of the client, even when Selfish has written said content. The client must review and approve all provided content before publication.

Limitation of Liability: Selfish The website will have no relationship, responsibility, or control over the products or services that the client offers, sells, or distributes through the developed website. The client will be solely responsible for all aspects related to their products or services, including but not limited to their quality, safety, regulatory compliance, advertising, and sales.

Disclaimer: Selfish will not be liable for any claim, damage, loss, or legal demand that may arise as a result of the client's use, sale, or distribution of the products or services through the developed website. The client agrees to indemnify and hold harmless Selfish from any liability that may arise in connection with their products or services.

Customer Autonomy: The client acknowledges and accepts that Selfish acts solely as a provider of web design and development services, and has no involvement, interest or control over the client's business operations, decisions or activities.

Maintenance and Support 

    1. Maintenance: Selfish We may offer maintenance services to ensure the website remains up-to-date and functional. These services will be detailed in a separate agreement and may include software updates, security measures, and bug fixes.
    2. Technical support: Technical support will be provided free of charge for the first 20 (twenty) calendar days after the final project is delivered. After that period, technical support may be offered as an advisory or consulting service at a cost of MXN 490 (four hundred ninety Mexican pesos) per hour.

Live design and programming:

Selfish It offers the possibility of conducting design sessions and live programming, in which the client can observe the development process or request adjustments in real time. These sessions require an extra commitment of resources and time, and are therefore considered a premium service.

The cost of these services will be higher than the regular rates and will depend on the complexity and duration of the session. This additional cost will be specified in the quote.

Live design or programming sessions do not guarantee specific results or replace the formal review, documentation, testing, or approval processes established for the project.

Information Management:

Selfish We can manage the information provided by the client, including organizing, reviewing, and adjusting the content to ensure its proper integration into the website or application. This additional service incurs an extra cost due to the time and resources required. The specific cost will be communicated to the client and included in the quote.

Link to the Website of Selfish:

Selfish reserves the right to include a link to its website on the web pages it develops. This link will serve to identify Selfish as the site developer. If the client wishes to remove this link, they can negotiate this option directly with SelfishIf you agree to remove the link, an additional fee may apply.

Ecommerce

    1. For ecommerce sites (online stores):
        1. An initial payment of 50% of the total project cost is required at the start of the project.
        2. The remaining 50% will be paid upon delivery of the final project.

    1. Payment Gateways: Transactions will be carried out through payment gateways integrated into the website. Selfish It has no responsibility for the transactions carried out or for any problems that may arise with the payment gateways.

Disclaimer: Selfish will not be liable for any claim, damage, loss, or legal demand that may arise as a result of the use, sale, or distribution of the customer's products or services through the developed e-commerce website. The customer agrees to indemnify and hold harmless Selfish from any liability that may arise in connection with their products or services.

Customer Autonomy: The client acknowledges and accepts that Selfish acts solely as a provider of web design and development services, and has no involvement, interest or control over the client's business operations, decisions or activities.

The client agrees to indemnify and hold harmless Selfish from any liability that may arise in connection with their products or services.

Customer Autonomy: The client acknowledges and accepts that Selfish acts solely as a provider of mobile application design and development services, and has no involvement, interest or control over the client's business operations, decisions or activities.

Maintenance and Support

Publication in App Stores:

    1. Publication Process: Selfish We can assist with publishing your app on the app stores (App Store and Google Play Store). However, approval and review times depend on the policies and procedures of the respective app stores.
    2. Store Policy Compliance: The client is responsible for ensuring that the application complies with the policies and requirements of the app stores where it will be published. Any rejections or issues related to non-compliance with these policies will be the client's responsibility.

Graphic Design and Branding

Payment Terms and Conditions

  1. For graphic design and branding services:
      1. An initial payment of 50% of the total project cost is required at the start of the project.
      2. The remaining 50% will be paid upon delivery of the final project.
      3. Si Selfish If desired, a monthly payment plan with an interest rate can be offered, which will be stated in the quote.

Adjustment Rounds: All graphic design and branding projects include two rounds of adjustments, unless otherwise stated in the quote.

Content Responsibility: The content provided for the designs is the responsibility of the client, even when Selfish The client must review and approve all provided content before it has been created or edited.

Delivery of Materials: 

    1. File Formats: The final materials will be delivered in standard file formats (e.g., JPEG, PNG, PDF, AI, EPS) as specified in the quote.
    2. Usage Rights: Once payment is complete, the customer obtains the commercial rights to use the final product. However, Selfish retains the intellectual property of the original design.

Limitation of Liability: Selfish The company will have no relationship, responsibility, or control over how the client uses the designs and materials provided. The client will be solely responsible for ensuring that the use of such materials complies with all applicable laws and regulations.

Disclaimer: Selfish will not be liable for any claim, damage, loss, or legal action that may arise as a result of the client's use of the design and branding materials. The client agrees to indemnify and hold harmless Selfish from any liability that may arise in connection with the use of the designs and materials provided.

Customer Autonomy: The client acknowledges and accepts that Selfish acts solely as a provider of graphic design and branding services, and has no involvement, interest or control over the client's business decisions, marketing strategies, or activities.

Maintenance and Support:

    1. Minor Revisions: Selfish We may offer minor revisions to design materials after final delivery, which will be detailed in a separate agreement and may incur an additional cost.
    2. Technical support: Technical support for the proper use of the materials will be provided for the first 20 calendar days after delivery of the final project. Afterward, support may be offered in the form of advice or consulting at a cost of MXN 490 (four hundred and ninety Mexican pesos) per hour.

Use of Third-Party Materials: 

    1. Copyright: The client must ensure that any third-party material provided for inclusion in the designs (e.g., images, fonts, logos) has the corresponding usage rights. Selfish is not responsible for copyright infringements related to materials provided by the client.

Hosting and Domain Registration

Payment Terms and Conditions:

    1. For hosting and domain registration services:
        1. A 100% initial payment of the domain registration cost and the first year of hosting is required at the start of the service.
        2. Hosting and domain renewal payments must be made before the service expiration date to avoid interruptions.

Content Responsibility: The content hosted on the hosting services is the responsibility of the client. The client must ensure that all content complies with applicable laws and regulations.

Availability and Uptime: Selfish We will strive to maintain 99.9% availability of our hosting service. However, this availability may be affected by factors beyond our control (scheduled maintenance, DDoS attacks, provider outages, internet interruptions, or other force majeure events), and therefore does not constitute an absolute guarantee.

Security and Backups:

    1. Security measures: Selfish We will implement reasonable security measures to protect data hosted on our servers. However, absolute security cannot be guaranteed, and the client acknowledges the inherent risks of using digital services.
    2. Backups: For the "Business" and "VPS" hosting plans, Selfish You can perform regular automatic backups. These backups are intended as a backup measure and do not replace the customer's obligation to maintain their own independent backups.
    3. La delivery or restoration of backups It will only be done upon request from the client. Under no circumstances Selfish does not guarantee the immediate availability of a specific backup, nor is it responsible for the total or partial loss of information resulting from system failures, human errors, external attacks or causes beyond our control.

Renewal and Termination:

    1. Service Renewal: It is the responsibility of Selfish Notify the client of the expiration of the hosting and domain registration service at least 7 (seven) days prior to the expiration date. It is the client's responsibility to pay the renewal fee at least 1 (one) business day prior to the expiration to avoid service interruptions.
    2. Service Termination: Selfish We reserve the right to terminate the hosting and domain registration service if the client does not comply with the payment terms or if they use the service for illegal or unauthorized activities.

Limitation of Liability: Selfish The company will have no relationship, responsibility, or control over the content hosted by the client. The client will be solely responsible for all aspects related to the content and use of the service.

    1. Service Interruptions: Selfish will not be liable for any claim, damage, loss, or legal demand that may arise as a result of hosting service interruptions or problems with domain registration.

Disclaimer: The client agrees to indemnify and hold harmless Selfish from any liability that may arise in connection with the use of the hosting and domain registration service, including any claim related to the hosted content or activities carried out through the domain.

Customer Autonomy: The client acknowledges and accepts that Selfish acts solely as a provider of hosting and domain registration services, and has no involvement, interest or control over the client's business operations, decisions or activities.

Technical support

    1. Basic Support: Basic technical support will be provided directly via WhatsApp Monday through Friday from 9:00 AM to 6:00 PM at no additional cost for the duration of the service. In addition, the ticketing system and AI chatbot will be available 24 hours a day, 365 days a year.
    2. Premium Support: Premium technical support, which includes direct assistance, custom configuration, and troubleshooting of complex issues, is offered Monday through Sunday from 7:00 a.m. to 11:00 p.m. It can be added for an additional cost of MXN 4,900 (four thousand nine hundred Mexican pesos) per month.
    3. Premium support per eventPremium technical support can be contracted per event, in the form of advice or consulting at a cost of 690 MXN (six hundred and ninety Mexican pesos) per hour.

SEO & SEM

Payment Terms and Conditions:

    1. For SEO & SEM services:
      1. Services will be billed monthly in advance. Full payment for the month must be made at the beginning of each service period.
      2. The amount charged by Selfish This includes only account setup and campaign management. Advertising costs will be covered separately by the client.
      3. There are no fixed terms required for SEO & SEM services. However, to achieve significant results and sustained performance improvement, a minimum contract period of 3 months is recommended. This duration allows for the proper implementation of strategies and the observation of their impact on campaign performance.

Adjustment Rounds: SEO & SEM projects include two rounds of initial adjustments based on the audit and approved strategy, unless otherwise stated in the quote.

Content Responsibility: The content used for SEO & SEM strategies is the client's responsibility, even when Selfish The client must review and approve all provided content before publication.

Technical requirements:

    1. Compatibility: The SEO & SEM strategies implemented will be compatible with major platforms and search engines, including Google, Bing, and Yahoo.
    2. Usability Standards: SEO practices will comply with usability standards and search engine guidelines to ensure an effective user experience and improved ranking.

Limitation of Liability: Selfish It does not guarantee specific results in terms of search engine rankings or return on investment (ROI) due to the variable and competitive nature of SEO and SEM. The client will be responsible for other factors that may influence performance, including but not limited to product quality, competition, and market fluctuations. 
The metrics, projections, estimates, or scenarios shared are for informational purposes only and do not constitute a guarantee of results, positioning, or return on investment.

 

Disclaimer: Selfish will not be liable for any claim, damage, loss, or legal action that may arise as a result of the SEO & SEM strategies implemented. The client agrees to indemnify and hold harmless Selfish from any liability that may arise in connection with the use of such strategies.

Customer Autonomy: The client acknowledges and accepts that Selfish acts solely as a provider of SEO & SEM services, and has no involvement, interest or control over the client's business decisions, marketing strategies, or activities.

Monthly Report: A monthly report will be delivered at the end of each month, detailing the performance and results of the implemented SEO & SEM strategies. This report can be explained in a call, if the client prefers, to discuss the results and adjust strategies as needed.

Payment Terms and Conditions

  1. For motion graphics services, whether animated logos or videos:
      1. An initial payment of 50% of the total project cost is required at the start of the project.
      2. The remaining 50% will be paid upon delivery of the final project.
      3. Si Selfish If desired, a monthly payment plan with an interest rate can be offered, which will be stated in the quote.

Content Responsibility: The content provided for the designs is the responsibility of the client, even when Selfish The client must review and approve all provided content before it has been created or edited.

Delivery of Materials: 

    1. File Formats: The final materials will be delivered in standard video file formats (e.g., MP4, WEBM) as specified in the quote.
    2. Usage Rights: Once payment is complete, the customer obtains the commercial rights to use the final product. However, Selfish retains the intellectual property of the original design.

Limitation of Liability: Selfish The company will have no relationship, responsibility, or control over how the client uses the designs and materials provided. The client will be solely responsible for ensuring that the use of such materials complies with all applicable laws and regulations.

The client agrees to indemnify and hold harmless Selfish from any liability that may arise in connection with the use of the designs and materials provided.

Customer Autonomy: The client acknowledges and accepts that Selfish acts solely as a provider of motion graphics services and has no involvement, interest, or control over the client's business decisions, marketing strategies, or activities.

Maintenance and Support:

    1. Minor Revisions: Selfish We may offer minor revisions to design materials after final delivery, which will be detailed in a separate agreement and may incur an additional cost.
    2. Technical support: Technical support for the proper use of the materials will be provided for the first 7 calendar days after delivery of the final project. Afterward, support may be offered in the form of advice or consulting at a cost of MXN 490 (four hundred and ninety Mexican pesos) per hour.

Use of Third-Party Materials: 

    1. Copyright: The client must ensure that any third-party material provided for inclusion in the designs (e.g., images, fonts, logos) has the corresponding usage rights. Selfish is not responsible for copyright infringements related to materials provided by the client.
